Today out of a sudden, my colleague suggested that we go to Jalan Yew for Lum Mee. I agreed and this is the FIRST TIME any of us drove out of our office for lunch because of the ridiculous parking rates in our office. But for Lum Mee, we went anyway and i drove.
Right before we reach Jalan Yew, we were cruising happily and all smooth until suddenly…
BANG~
My car was hit on the driver side from my front tyre till the back tyre. (ACTUALLY, i was hit at the back first and then she dragged her car right up till the front fender)
Location of the accident, at Bulatan Pudu. :(
My defense, i was already out from my junction. The Red X marks where i was hit. The Honda Accord that hit me, WFP 6822 was a modified car with dark tinted and very lowered bumper. Her damage was a dent on the Left Bumper at the corner of her car.
the so called police’s car. the tinted sure looks nice right?
We couldn’t stop there obviously since it’s very jam at that time (12pm) and the traffic is mad. Note that during the accident both of us were super slow because JAM, we move forward to Jalan Yew, find a parking to discuss.
As i got down from my car….
:( . Sigh. another accident. And AGAIN kena hit by people. :( Then i saw my car. SIGH. ….

HADIBAH :: MY HUSBAND PUN POLIS OK. (the she pulled out her polis ID and i saw that she was just a police konstabel)

me :: So awak polis so? My father is also a police office does that mean you can hit someone and scold them?
HADIBAH :: *ignores me and call her husband* ” blablabla .. ada orang langgar saya lah tak tau sekarang tengah cakap dengan dia lah ni… niha aku kena langgar blablabla”
*passes me the phone* MY HUSBAND NAK CAKAP NGAN U
me :: hello? who’s this?
husband :: KENAPA AWAK LANGGAR KERETA? U TAK NAMPAK KER KERETA DIA TU? (insert scolding for 5 minute)
me :: Kenapa awak tinggikan suara and bercakap dengan saya? ADA TAK SAYA MARAH AWAK? ada tak saya cakap awak yang salah? sekarang kereta saya rosak dari tayar depan ke belakang. u ingat siapa yang salah? kalau tak puas terus lapor balai.
husband :: *continue insert scolding from the husband*
me :: HEI! (I LOST MY TEMPER). AWAK MARAH SAYA NI UNTUK APA? AWAK ADA KAT TEMPAT KEJADIAN KER? SKRANG NAK CAKAP SIAPA BETUL OR SALAH BUKAN AWAK? BUAT APA AWAK MARAH SAYA.
husband :: BIARLAH AWAK TAK SUKA LAPORLAH BALAI.
me :: memang pun saya akan lapor.

then she called the husband again .. dono what happen there. we exchange information. then me and my colleague went to have lunchie and head to the balai polis trafik at petaling street.

the poor car that bang me. or should i say.. i banged.
when we reach there.. we saw the husband and wife there.
they reported the incident before us and were chatting with the staffs there. So i continued my reporting and went to see the Pegawai handling our case. Sgrt. Rasidi (NO : 110471) . Upon entering, i already felt something wrong because both husband and wife was sitting outside the room and talking with another officer and i heard the officer say “dont worry.. we will settle this.. blablabla”
so… i went in the room, sit in front of SGT RASIDI and he gave me this smirk on the face. and then i handed my report to him and then he said …
“Sebab dia datang dulu, i akan tengok dari apa yang saya dah dengar. Dalam kes ini, dia pengadu no 1, you no 2.”
“sekarang you tunjuk kat saya apa yang jadi”. and then he handed two toy cars for me. I showed him what happened exactly with my colleague sitting beside me.
Then without even thinking or anything, he said.
“Sekarang dari apa yang i dah dengar, i akan bagi you saman. Kalau you tak puas hati, you boleh bawak kes ini pergi makamah”
i was like. WHAT? DID I HEAR EVERYTHING
CORRECTLY? I WAS HIT. AND I GOT A SUMMON?
Then i argued. I was not even turning out from the roundabout. I WAS ALREADY IN THE ROUNDABOUT and I AM NOT THE ONE TURNING ANYWHERE. i am following the flow of the traffic and SHE WAS THE ONE who put the left indicator and TRIED TO GO INTO MY LANE BUT DINT BRAKE ON TIME and HIT MY DAMN CAR. FROM THE FRONT TYRE TILL THE BACK!
my car’s damage. :( front tyre to back tyre. scratches at the back, dent at the door and front fender :( not forgetting, my stickers :(
then he said
“Okay kalau u tak puas hati boleh tanya my IO (Investigation Officer)”, and the IO name is MANI. WTF.
But MANI was out for lunch, so he ask me to ask the rest of the officer who is at fault in this case. One of the officer then said.
“Well obviously you are wrong because the law says that IN A ROUNDABOUT PRIORITY IS GIVEN TO THE RIGHT LANE
and SHE WAS IN THE ROUNDABOUT FIRST. ”
so it was my fault, to be there at that time… to be hit.
right. I am super dissatisfied. BECAUSE IS THERE SUCH RULE SUCH AS just because you are in a roundabout first you can HIT anyone and not be blame for it?
Just because you are in the right lane YOU CAN HIT ANY CAR?
IS THAT THE FUCKING RULE?
so i kept arguing, giving my justification. each and everytime i was just given this explanation, that i am wrong because she is in the right lane.
even if i was in a one lane road and following the flow of the traffic and just got hit innocently like that.
No matter how i argued, apparently i was still wrong. because i just so happen to be there that time.
and the funny thing was.. all of the officers had this smirk on the face i felt like there must have been something happening earlier on in the same place.
Mani the IO then return and after hearing the incident again from me, he ask SGNT RASIDI to bring me and the other woman to the scene again and take photos.
Deep inside, i already know that no matter what, he will say i am wrong. and boy am i so right. Just at the scene, i show him where i was hit and he kept arguing until i said so this is the law huh? for me to be going on my lane and she cut into mine and hit me on my side and not just my mudguard or fender but my whole SIDE and i was wrong because i just so happen to be there turning into m lane which is a one way lane? is this YOUR JUSTIFICATION?

with that.. i just dont feel like speaking anymore to HIM or to any officers at all because i know no matter what i say, i will still get the summon no matter what.

then Sgnt Rasidi look at me.
Sgnt rasidi says : Okay sekarang ambik gambar kereta you. Lepas tu you masuk ya?
me :: ok (continues to show the police my car)
Some other police :: (took the picture of my number plate)
me :: (because i felt something wrong since i WAS THERE) You dah ambik gambar kerosakan?
Some other police :: sudah
me :: YER KER? TAK NAMPAK PUN? YOU AMBIK NUMBER PLATE JER? TUNJUK?
Some other police :: tak boleh. Ini computerized punya. lepas ambik masuk dalam komputer kat dalam.
WHAT THE FUCK. SERIOUSLY. WTF?
i already know what is the outcome when i go in. i don’t even have to say anything.
Upon entering the office, SGNT RASIDI ask me to sit down and wrote me the summon. He then told me the summon comes to the amount of RM1000 but minimum amount if i plea when i pay will be RM300 and the amount will be known when i go and pay. If i am not satisfied, i can just go to court.
well well.
if i am guilty… if there is a right justification to this… i will pay the summon no matter what.
but because i was so INNOCENTLY HIT. AND THEN GOT A SUMMON for being hit. AND because of all the things that happen prior to that… i am COMPLETELY ANGRY. AND REALLY REALLY ANGRY. at how this case is justiced. Just because that husband and wife are police officers i get blamed for being HIT? IS THAT FAIR?
Seriously. WELCOME TO MALAYSIA. WHERE THE COPS RULE. and if you get hit by a police, you get a summon for it.
My colleague was there. in the car. in the police station. there with me, and he witnessed everything.. how everything was just PLAIN ABSURD. FROM THE START.
I cant even express how angry i am because just thinking at the smile SGNT RASIDI have when he saw me i felt like puking.
Malaysia’s law is so fucked up that not to say im racist , but the department police officers were MALAY and they were looking at me with this “LOOK” just because i speak english and because i wore a SPAGGETTI. and the way they speak to me leaves me no chance to even describe what have happen because no matter how i say it, they say the law is at her side because she is in the right lane.

The thing is, MY CAR WAS IN SAFELY PARKED IN A SLOT, THE POLICE CAR BANGED IT WHEN THEY TRIED TO PARK IN THE SLOT BESIDE ME!!!! Then they drove off immediately. I was having lunch! And i saw everything!

1st, there is no such thing as RM 1000 summon.
2nd, max summon requires RM 300 onli. if the claimer wanna claim damages from insurance, they must leave their car for 3 months at police station.
3rd, i had never heard of such rule that the right lane is always right. Usually roundabout cases are difficult to argue and police usually end up ignoring or giving both summon.
4th, this is what the world is usually doing right now. its a same old tactic.. I experienced before now im sharing it with u. They usually make u angry at first. So that u won’t calm down and think logically. Next thing is that there will be conspiracy happening behind which u won’t notice becoz u r in a angry mood. They will ask u to go to police station together to a known

What u shud have did :
1) do not leave the spot where u actually hit by the car. Dun care whether it will coz jam to others or what. Just dun leave the spot.
2) do not let the person leave. call someone if he or she trying to be unreasonable so that u are showing u are willing to make this case big,
3) do not follow her to the police station if she asked u too. there’s a high chance that policemen is a culprit alltogether.
I guess i made a mistake. I shouldnt have leave the place. And from all days, i left my camera in the office that day. sigh :(
I totally agree with Paul, especially point no 3. The policeman even worse than monkey (i dunno what even worse than that). It happened to me early this year, a trailer hit my car exactly the same spot as U. In the end I had to claim my own insurance, and still the fucking policemen insisted to summon me. After big argument and I raised some tecnical points regarding the accident, he just speechless… no point to counter. Week after that I found out that the POLICEMAN took bribe from the owner of the lorry. Stupid POLICE. And to share with you, even tho Im malay, I totally aggree with U that the most STUPID, LOW MORALE, PIG HEAD etc policeman is MALAY. Trust me I dealed with them lots of time!

But on the other hand, let’s say if you bring this up to court, maybe they will concern a bit coz policeman nor the government would spend that kind of money on your case because they will state your case as “simple case” plainly they can just saman you like that and have it settled! used to face this issue till the court case in penang. same thing happen as the bugger who hit me bride the police till i get to know the head of JPJ was my uncle’s friend. problem resolved without paying single cent after this.

I have also encountered situation like this. That time I was on the roundabout already then a van just banged my car from the side at the back till the front.
Obviously I am in front of the van already and when I went to report the case, I encounter almost the same situation you encountered. They knew the policemen inside and were talking like long lost buddies.
Next, I am told that it’s my fault. In roundabout…the right side rules… Give way to the right bah… No matter how I argue also no use..
So, next time…If you are angry with anyone, just wait at the roundabout and bang their car from the right side…. Kao tim..

6 months ago, my car stalled on the shoulder lane of BESRAYA highway, and a car hit me from the back. I went to jln bandar station to make a report, and sgt rashidi was the “I/O”. after threatening with a summon (which i don’t get why!- since I was hit from the back, and I was stopped due to an emergency) and a tit n tat for 30 mins (he s probably waiting for me to bribe him), i GOT SUMMONED! rm300! fucking hell!
Honestly, i don’t know how law is practiced in this countyr. I was told that the legal fee would be more than rm300, it’s probably better to suckered up and claim insurance for the damage. worse is, because i got summon, the insurance co said I will lose my “no claim” bonus.

Sad to say but the Police officer is correct technically. Priority is given to the RIGHT lane. But from what you wrote, I am guessing you were inching at the roundabout since there was a jam and her vehicle grazed into yours. She should have kept her distance but then again, technically under the road transport act, she has the right of way.
For example, many Malaysian drivers love to come out from a side road and drive slowly. When you honked at them, they have the mentality of ‘if you knocked into their rear, you are in the wrong’. But under the act, if you knocked into the rear of a third party vehicle which emerged from a side road, where the third party vehicle has traveled less than 30 meters from the side road, the third party is in the wrong. Priority is given to the traffic from the right.
You could bring the matter to court but I think the chances of you winning the case is slim.
I would have agree to that if her vehicle is in front or beside mine and tries to cut in front of me. But the case is so that she is behind me and tried to get into my lane but hit my car instead.

Jenni, I took my case (like yours) to court. The IO, etc did not turn up the first time. Case postponed. When summoned again after pleading not guilty the magistrate asked the police to make their stand. They were not there. I raised my vloice at the Magistrate to remind him that this is the second time the cops were not present. He had no records of that and I showed him my documentation of the first hearing….names of magistrate, etc. Case dismissed. I wrote to the NST with full details of names etc. burt it never saw print.
Jenni, how come a constable can own a Honda….business must be good. Take it to court and fuck them blind. I did that.

In our case, NO! We cannot trust our policemen. When we were young, we we brought up to be afraid of them. Even at 35 yo now, I hate and I scared to meet a policeman. Not because I am a criminal or done anything wrong. That is because I am scared they suddenly see me as a victim for them to bully. So sad, that’s the situation in this country. Police is not my friend, but our big bully.
Anyway, if there is a rule saying that the person report first is innocent, then what if my car is hit but so badly damaged that I cannot drive it? While waiting for it to be towed away, I got delayed (by an hour or so), then I am automatically considered guilty? That is bullshit. The right side rule is also bullshit. Like the other blogger said, we better stay on the right side and hit anyone if we hate them! :(

i’m really sorry to hear that. personally, i don’t like the way our malaysian cops work. last time i was involved in a snatch theft incident.. and until now, still no news from the fcked up police inspector. it’s been like, more than a year now. the blardy thief even did a credit transfer out my hp credit.. i called Maxis about this and they confirmed that somebody did transferred out.. So, this means that they can know who is the transferrer at that point of time. But since it’s P&C, i decided to go to the police station again to tell them abt it.. but still, they keep on saying, “we’ll do our job.. leave this to us” without even acknowledging this important piece of info. crap… i am never trusting any cops again. ><”
They’re the same everywhere. My office used to be broken in. We went to report police and before anything was done, ” Telefon saya tak ada kredit lagi. Nanti tolong kasih reload RM30. Lepas tu, telefon saya, saya pergi tengok keadaan” WTF !!!
and there were many other incidents with RASUAH everywhere .. Saya AUNTY rasuah !!!

i had an accident few years ago, and my friend told me to hurry to the police station before the other party does, because ”priority” will be given like first come first serve basis. luckily the ones in pj are more civilized than the ones you met. But i think its rubbish because what matters the most is WHO IS AT FAULT not talking about privileges.
somore using status to scare you off, omg..dont they know their ‘glorious days’ are so over with all dirty allegations coming up against them. i have a feeling even though u bring this issue to court, it might be a ‘fishy’ one with all the ‘teh tarik + roti canai giveaway’ . Perhaps our opposition leaders or non mainstream-controlled media will shed some light on your plight.

well i got my license suspended because i refused to bribe.
that fucker said… kalau u tak nak settle saya tau u punya license kena gantung.. so fuck that and i shouted at that fat ugly hairy bastard…. that was 3 years ago or so…
so fine… great everything went well i paid my summon and true enuf he almost got my license fucked….. so well yeah….
and then i got into a pile up in ldp because alot of fuckers on the raod want to drive fast when it is raining and drag others with them… the front 2 cars (racing) jam break and dragged 3 others with them…. and u know ldp la… callman pouring oila nd when it rains damn fucked up…
nabei 5 people jam brake and i so unlucky being the last one and in a kelisa….. no abs, no anti skid, lightweight, 2 brakes which do no good in rain, even when i was using wet-road track racing tyres…( i do track events every now and then so i got a few set of tyres which i use depending on the season)…. so i went to the station the same bastard i met that time was there… u salah … u langgar belakang u last u salah…. saya tak kisah apa you cakap… ini undang undang..

those facts together with the fact that the 2 idiots at the front started the freaking accident and i was the last car to end up in the pile up ( all those infront of me had already crashed bumper to bumper)….
